During the Civil War, President Abraham Lincoln made a decision to stop a legal process called habeas corpus. This process allows a court to decide if a person being held by the government should be released or not. The Constitution says that the government can stop this process in certain situations, like during a rebellion or invasion. Lincoln’s decision meant that Union soldiers could arrest people who supported the South and others who were seen as a danger to public safety. These people could be held in jail for a long time without a trial. This also meant that the military had more power than the regular police.

After the war, there was a big argument about whether Lincoln’s decision was right or wrong. The Supreme Court had to decide if it was legal. In a case called Ex parte Milligan, the court said that martial law, which is when the military takes over the job of the police, can only happen if the regular courts and governments are not working. It also said that martial law can only be used in a small area where there is actually a war happening. In 1878, a law called the Posse Comitatus Act was passed. This law made it illegal for the military to have power over regular people, unless the Constitution or Congress said it was okay. It’s important to know that this law doesn’t apply to National Guard troops who are under the command of state governments.
